Terms & Conditions

Purchase of an Image Hotspotter license (hereinafter “the license”) requires that the purchaser (hereinafter “the licensee”) agree to and shall abide by the terms and conditions presented here (hereinafter “these terms”) by ImageHotspotter.com (hereinafter “the licensors”).

The licensee further agrees to adhere to the requisites corresponding to the license, as detailed on the licensing page. Any breech of the license by the licensee is ground for revocation of the license without prior notification or monetary compensation. Such breech assumes the licensee means to permanently disable any and all installations of the plugin.

Note that these terms are subject to change at any time without prior notice, however valid licensees shall receive timely disclosure of any material changes in terms.


Software License

As a derivative work of WordPress, the Image Hotspotter plugin software is licensed under GNU General Public License v2.0.

Citations

The licensors may occasionally choose to cite a licensee as a featured consumer of the plugin. Notification shall be provided to any licensee should they be featured at any time. Should the licensee desire to be excluded from citations, the licensors will oblige any such request made with the corresponding valid license key.

Copyright

Licensee is entitled to no claim of copyright or intellectual ownership over any provided software. Image Hotspotter is authored and copyrighted by Rommel Santor.

Warranty

Image Hotspotter is provided “as is” without warranty of any kind, either express or implied, including but not limited to the warranties of merchantability or fitness for a particular purpose. In no event shall the licensors, authors, or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software.

Guarantee

Image Hotspotter has been designed and tested to work with WordPress 2.0.2 through WordPress 3.5 at minimum. It has not been tested with blogs hosted by WordPress.com. The software should not be expected to function as designed on a customized or an untested WordPress installation nor in conjunction with other third-party WordPress plugins that may cause compatibility issues with Image Hotspotter.

Should there arise a problem in your WordPress installation causing Image Hotspotter to malfunction, the licensors, solely at their discretion, may provide a reasonable amount of good faith effort in helping you to resolve your issues.


Software Acquisition

Upon full receipt and verification of your completed payment, an email notification will be sent to the email address from which payment was remitted. The email shall contain a license key and a hyperlink that may be used to download the plugin as a zip file. The license key is important as it must be supplied whenever issuing a request for technical support or for downloading software upgrades.

Once our server has been notified by PayPal of your successful payment, the email should be sent to you within a matter of minutes. If the email does not arrive promptly after you have submitted payment, it may be that your email service moved it into your “spam” or “trash” folder or that PayPal has been delayed in notifying our server of your payment. If the email is nowhere to be found after a reasonable amount of time, please contact us.

Please note that when paying by e-check it may take several days before PayPal clears your payment, so you should not expect the email to arrive until that process is fully complete.

Technical Support

Support is offered as a service to valid licensees and only for the latest version of the software. (Support for previous versions shall not be offered.)

Should the licensee have any questions or encounter any problems regarding the software, a request for technical support may be initiated by contacting us. Note that a valid license key must be provided when the request for support is issued.

Requests for support shall be answered as quickly as possible during normal business hours. Under usual circumstances this may be within a matter of hours, however it should be understood and expected that there may be a delay of up to 24-48 hours.

Software Upgrades

As development of Image Hotspotter continues, software upgrades shall be introduced. As new versions of the software are released, licensees with a valid license key shall be notified via email with a download link. Note that in order to download a software upgrade, your valid license key must be provided.

Licensees are encouraged to install upgrades as soon as they are available to take advantage of any new features added or bug fixes implemented.

Refunds

In general, refunds shall not be offered except under extraordinary circumstances. It is solely at the discretion of the licensors if your circumstances qualify, but refunds will be considered only if the software’s basic feature set is proven non-functional despite a reasonable effort by the licensee to follow the instructions by the licensors.

Misinterpretation by the licensee of the software’s feature set is not ground for a refund. Should you desire any explanation or clarification prior to purchasing a license, please contact us.

Under no circumstances shall a refund be offered beyond 30 days from the date of purchase by the licensee.

Proprietary Information

Any correspondence from the licensors must be considered confidential and proprietary information. At no time shall any licensee publish, whether publicly or privately, share with a third party, or enable any third party to acquire any information provided by the licensors. The license key provided to a licensee must not be made known by any third-party.

Acceptance of Terms

By purchasing a license, the licensee expressly agrees to abide by these terms and affirms these terms have been read in full and completely understood. If any portion of these terms remains unclear, please feel free to contact us for clarification.
